Axlor Consulting reports cited in basis for judge’s opinion approving consent decree with Cornell-Dubilier Electronics, Inc.
On October 2, 2014, the U.S. District Court, District of New Jersey, approved the United States’ proposed Consent Decree with Cornell-Dubilier Electronics, Inc. (“CDE”) concerning the CDE Superfund Site in South Plainfield, New Jersey, overriding the Intervenors’ motions and finding the Consent Decree to be “fair, reasonable, and consistent with the goals of CERCLA.” The CDE facility manufactured capacitors and other electronics at the site. Studies and cleanup are ongoing to remove and control PCBs, solvents, and metals found in buildings, soils, groundwater, and sediments. In reaching his decision, U.S. District Judge Jose L. Linares cited expert and rebuttal reports by Axlor Consulting principal, Gayle Schlea Koch, concerning future remedial cost estimates and appropriate discount rates.
